Standards & Verification Protocol

Audit & Readiness Assessment Methodology

The standardized 5-phase evaluation protocol applied by LLM Advocates across all 75 Indian industry sectors and 5,590+ statutory controls.

1. The 5-Phase Audit Lifecycle

Phase 1: Diagnostic Scoping & Boundary Definition

Determining legal entities, joint data fiduciary relationships, sub-processors, and geographic scope under Section 3.

Phase 2: Comprehensive Technical Data Discovery

Database schema audits, API traffic inspections, log analysis, and departmental interviews mapping personal data flows into a verified RoPA.

Phase 3: Statutory Control Evaluation & Scoring

Evaluating controls across 8 categories: Notice, Consent, Lawful Bases, Security, Children Data, Processor Agreements, Rights Automation, and Incident Readiness.

Phase 4: Statutory Penalty Exposure Modeling

Quantifying risk under Section 33 schedules (Critical, High, Medium, Low) based on volume of data principals, nature of breach, and mitigation capabilities.

Phase 5: Remediation Architecture & Executive Reporting

Delivery of Board-level Executive Audit Report, Statutory Gap Register, and an engineering action plan.

2. Scoring & Priority Formula

Readiness Score (%) = [ Controls Verified Compliant (YES) ] ÷ [ Total Applicable Controls (Excl. NA) ] × 100

Controls are weighted by statutory enforcement risk: Critical (immediate breach of Section 6/8/9 with up to ₹250 crore exposure), High (statutory rights failure under Sections 11–14), Medium (operational documentation), and Low (procedural governance).
