Terms of Service

Last updated: October 27, 2026

1. Acceptance of Terms

By accessing or using the LLMASSURE platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Platform on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Platform Description

LLMASSURE is a Consent Management Platform (CMP) that provides:

  • DPDP Compliance Audit & Certification: Assessment against the Digital Personal Data Protection Act, 2023 and DPDP Rules, 2025
  • CMP Subscription: Working consent management infrastructure — notice builder, consent capture, hash-chain proof, withdrawal, renewal, and embeddable widget
  • DPO Advisory: DPO-as-a-Service for Significant Data Fiduciaries
  • Free Tools: Industry-specific self-assessment and penalty calculator

3. Important Disclaimers

3.1 CMP, Not Consent Manager: LLMASSURE is a technology platform (CMP). We are NOT a registered "Consent Manager" as defined under Section 6(7)–(9) of the DPDP Act and do not perform functions requiring DPBI registration.

3.2 Compliance Responsibility: While we provide compliance tools and advisory services, the ultimate responsibility for compliance with the DPDP Act remains with the Data Fiduciary (you, our client). Our assessments are advisory in nature and do not constitute legal advice.

3.3 No Legal Advice: Content on this platform, including DPDP Act explanations and compliance checklists, is for informational purposes only and does not constitute legal advice. Consult a qualified legal professional for specific compliance decisions.

4. User Accounts

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must enable MFA if assigned admin or DPO roles
  • You must not share account access or credentials with unauthorised persons
  • You must promptly notify us of any unauthorised use of your account

5. CMP Subscription Terms

If you subscribe to the CMP service:

  • Data Processing: We act as your Data Processor under Section 8 of the DPDP Act. A Data Processing Agreement (DPA) governs this relationship
  • Your Obligations: You remain the Data Fiduciary. You are responsible for the lawfulness of processing, accuracy of notices, and compliance with all DPDP Act obligations
  • Our Obligations: We will process data only on your behalf and as documented in the DPA. We maintain audit logs, implement security safeguards, and support your compliance
  • Data Retention: Upon termination, we will erase or return your data as specified in the DPA, subject to any legal retention obligations

6. Self-Assessment Tool

The free self-assessment tool provides an indicative compliance readiness score based on industry-specific checklists. Results are:

  • Informational only — not a certification or legal opinion
  • Based on self-reported responses — accuracy depends on your inputs
  • Saved to your account if logged in, or generated as a lead capture if used publicly

7. Intellectual Property

All platform content, design, and code are the intellectual property of LLM Advocates. The DPDP Act text and Rules are public domain legal content reproduced for informational purposes. Industry-specific compliance checklists are proprietary compilations.

8. Limitation of Liability

To the maximum extent permitted by law:

  • LLMASSURE is provided "as is" without warranties of any kind
  • We do not guarantee that using our platform will make you fully DPDP-compliant
  • We are not liable for any penalties imposed by the Data Protection Board due to your non-compliance
  • Our total liability is limited to the fees paid by you in the preceding 12 months

9. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

10. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email and a notice on the platform. Continued use after changes constitutes acceptance.
