Data Fiduciary (Section 2(i))
Any person who alone or in conjunction with other persons determines the purpose and means of processing personal data. Equivalent to the GDPR "Data Controller". Holds primary legal liability for compliance.
Data Principal (Section 2(j))
The individual to whom the personal data relates. Where such individual is a child (under 18) or a person with disability, includes the parents or lawful guardian.
Data Processor (Section 2(k))
Any person who processes personal data on behalf of a Data Fiduciary. Does not determine the purpose of processing. Must process data only under a valid Data Processing Agreement.
Significant Data Fiduciary (Section 2(z) & Section 10)
Any Data Fiduciary or class of Data Fiduciaries notified by the Central Government based on volume of data, risk of harm, potential impact on state sovereignty, or electoral democracy.
Personal Data Breach (Section 2(u))
Any unauthorised processing of personal data or accidental disclosure, acquisition, sharing, use, alteration, destruction of or loss of access to personal data, that compromises the confidentiality, integrity or availability of personal data.
